Public Hearing: Andrew’s Auto Parts

PUBLIC NOTICE 

THE BOARD OF APPEALS FOR CHARLES COUNTY, MARYLAND shall continue the Show Cause hearing regarding IAAI, better known as Andrew’s Auto Parts, from the December 11, 2018 and April 23, 2019 Board of Appeals meetings.  IAAI was originally ordered to appear before the Board on December 11, 2018 and show cause why Docket #1257 should not be revoked. Docket #1257 was approved in February 2011 and allows the operation of an automobile dismantling or storage yard, as provided in Article XIII, Section 297-212 and Article XXV, Section 297-415 of the Charles County Zoning Ordinance. The Docket #1257 order required the Applicant to follow all applicable County, State, and Federal codes and they have been found to have violated two County Ordinances by placing asphalt millings without the appropriate permitting. This hearing resulted in the Board leaving the record open for 6 months, requiring the Applicant to reappear before the Board within the 6-month time frame to demonstrate what steps they are taking to remedy the identified violations.  This issue was revisited during the April 23, 2019 Board of Appeals meeting. Since positive progress in the permitting process was made prior to this meeting, the Board left the Show Cause Order open and allowed Staff to continue processing the Applicant’s Modification to their Special Exception. At this point, due to lack of progress in the permitting process, Staff is scheduling a continuation of the Show Cause Order for the April 27, 2021 Board of Appeals meeting. The subject property, designated as Tax Map 23, Grid 10, Parcel 377, is located at 4840 Crain Highway, White Plains, Maryland on approximately 26.564 acres.  The subject property is zoned Light Industrial (IG) and Community Commercial (CC) and within the Highway Corridor (HC) overlay.  

The Board of Appeals is hereby giving notice that a Public Hearing will be held on this matter Tuesday, April 27, 2021 at 7:00 p.m.. The meeting will be held remotely via video teleconference. Persons with questions or wanting more information regarding this hearing may call 301-645-0632 for further information. The hearing is open to the public, and public testimony is encouraged.

The relevant documents for Docket #1257 will be available for inspection on or after April 12, 2021 in the Planning Division, Planning and Growth Management Department, Charles County Government Building, La Plata, Maryland or online at: www.charlescountymd.gov/government/boarddocs.
